We do not warrant that the appearance, fit, or quality of a product will exactly match how it is displayed on a particular device or will meet every subjective expectation.

Montclair & Vale reserves the right to accept, reject, limit, or cancel an order for a lawful reason, including suspected fraud, payment problems, pricing or inventory errors, product unavailability, shipping restrictions, sanctions or trade restrictions, or inability to fulfill the order.

Your order is not accepted until Montclair & Vale confirms acceptance. Payment authorization or an automated order acknowledgment does not necessarily constitute final acceptance of the order.

Please review your order carefully before submitting it. We may be unable to accommodate changes or cancellation requests after processing or fulfillment has begun.

When an order is changed, rejected, or canceled, we will attempt to notify you using the email address, billing address, shipping address, or telephone number provided with the order.

Returns, exchanges, and refunds are governed by our Return and Refund Policy.

You represent that purchases are intended for legitimate personal or household use and not for unauthorized resale, unlawful export, fraud, or other prohibited activity.

Prices, discounts, promotional offers, and product availability are subject to change without notice. The price charged will generally be the price displayed when the order is submitted, subject to correction of errors and applicable law.

Unless expressly stated otherwise, displayed prices do not include shipping charges, taxes, customs duties, import taxes, brokerage charges, or other applicable fees.

Prices displayed in local currencies may be converted using currency-conversion services and may vary because of exchange-rate changes or payment-provider charges.

Promotions may be governed by additional terms. When promotional terms conflict with these Terms, the specific promotional terms will govern the promotion.

You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information. You agree to update your information promptly so that transactions can be completed and we can contact you when necessary.

You represent and warrant that:

  • The payment information you provide is accurate and complete;
  • You are authorized to use the selected payment method;
  • Charges submitted through the selected payment method will be honored; and
  • You will pay all properly disclosed charges associated with the order.

SECTION 5 — SHIPPING AND DELIVERY

Shipping rates, processing estimates, international shipping terms, customs obligations, tracking procedures, and delivery information are described in our Shipping Policy.

Processing and delivery dates are estimates and are not guarantees. We are not responsible for delays caused by carriers, customs authorities, weather, natural disasters, labor interruptions, transportation problems, security inspections, inaccurate addresses, or other circumstances outside our reasonable control.

Items from one order may be fulfilled from different locations and may arrive separately with different tracking numbers.

Title and risk of loss transfer as permitted by applicable law. Nothing in these Terms limits rights or remedies that cannot legally be limited or waived.

The Services, including trademarks, branding, text, displays, images, graphics, product reviews, videos, audio, software, and the design, selection, and arrangement of these materials, are owned by or licensed to Montclair & Vale, Shopify, or their respective licensors and are protected by applicable intellectual-property laws.

Montclair & Vale is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Montclair & Vale.

By using the Services, you acknowledge that Shopify is not responsible for the products sold by Montclair & Vale or for injury, damage, or loss resulting from those products or transactions. To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Montclair & Vale.

SECTION 10 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy. Certain personal information may also be processed in accordance with Shopify’s privacy practices.

We are not obligated to maintain Feedback in confidence, compensate you for Feedback, publish Feedback, or respond to Feedback.

We may monitor, reject, edit, or remove Feedback that we reasonably believe is fraudulent, unlawful, threatening, abusive, defamatory, obscene, infringing, misleading, unrelated, or otherwise objectionable.

You may not submit Feedback using a false identity or misleading contact information or misrepresent its origin.

The Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, dimensions, sizing, inventory, pricing, promotions, shipping charges, delivery estimates, or availability.

Subject to applicable law, we may correct errors, update information, or cancel affected orders at any time, including after an order has been submitted.

If an order is canceled after payment has been collected, the applicable amount will be returned to the original payment method, subject to payment-provider processing times.

You may access and use the Services only for lawful purposes. You may not use the Services directly or indirectly:

You remain responsible for amounts properly incurred before termination.

This limitation applies regardless of whether a claim is based in contract, tort, negligence, strict liability, statute, or another legal theory and regardless of whether the possibility of damages was disclosed.

Nothing in these Terms excludes or limits liability when exclusion or limitation is prohibited by applicable law.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Montclair & Vale, Shopify, and their respective affiliates, owners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal fees arising from:

  • Your material breach of these Terms or incorporated policies;
  • Your violation of applicable law or another party’s rights; or
  • Your unlawful or unauthorized use of the Services.

We will provide reasonable notice of an indemnifiable claim when practicable. You agree to reasonably cooperate in the defense of the claim.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary. The remaining provisions will continue in effect.

A failure to enforce a right or provision of these Terms does not waive that right or provision.

These Terms and the policies and operating rules posted through the Services constitute the entire agreement between you and Montclair & Vale regarding use of the Services and supersede prior or contemporaneous communications concerning the same subject.

An ambiguity will not automatically be interpreted against the party that drafted these Terms.

These Terms and any dispute arising from the Services will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where the mandatory laws of another jurisdiction apply.

Subject to applicable consumer-protection laws and any rights that cannot be waived, proceedings arising from these Terms may be brought in the state or federal courts serving Pinellas County, Florida.
